TERMS AND CONDITIONS
SPETTER TRAVEL, LLC DBA PINK CHICKEN VACATIONS®

These terms and conditions (“Terms and Conditions”) govern the relationship between Spetter Travel, LLC dba Pink Chicken Vacations®, herein referred to as Spetter Travel/Pink Chicken Vacations® (“we”/”us”/”our”), and the Passenger/Purchaser/Traveler/Client (“You/Your”) on behalf of all members of your traveling party. It is the sole responsibility of booking Passenger/Client to inform all other parties traveling of the contents of these terms and conditions. The booking Passenger, by planning and making payment, acknowledges receipt of, and hereby accepts these terms and conditions for travel-related services.

1. USE OF SERVICES: Spetter Travel/Pink Chicken Vacations® is an Independent Contractor of Outside Agents, Florida Seller Of Travel ST15578; California Seller of Travel# 2090937-50; Washington UBID 603189022; IA 1202
Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select. Passenger(s) acknowledge and agree to the terms and conditions of purchase imposed by Supplier(s) that they have selected as a service provider on an itinerary deposited and purchased.
You attest that you are at least 18 years of age and possess the legal authority to authority to enter into this Agreement and to make travel bookings with Spetter Travel/Pink Chicken Vacations®. You agree to be financially responsible for all your travel bookings made on behalf of yourself and members of your traveling party and attest that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate.

2. BOOKING ACCURACY/LEGAL NAMES: Review all documents upon receipt Passenger(s) agree to review your itinerary and other travel documents for accuracy and to inform us promptly of any issues. The names on travel documents must match your government-issued ID. Call Spetter Travel/Pink Chicken Vacations® if you have any questions. Passenger is required to immediately review all aspects of their booking to verify (but not limited to): passenger names, mailing address, email address, telephone number, date of birth, pricing, airfare, arrival/departure airports, accommodations, and organized activities on your booking receipt. Please notify Spetter Travel/Pink Chicken Vacations® immediately if any omissions and/or corrections are needed regarding the booking details. Passenger(s) voluntarily assumes full & sole responsibility for all risks and/or costs involved with failure to report such errors and/or omissions. Passenger is required to verify the accuracy of the passenger’s LEGAL first & last names as they appear on government-issued ID such as Passport.

3. TRAVEL DOCUMENTS: Passenger(s) assumes sole responsibility to independently confirm all documentation requirements for all passport, visa, vaccination, or other entry and/or travel requirements of each destination. Passenger(s) assumes sole responsibility for, and hereby releases Spetter Travel/Pink Chicken Vacations® from any claims or responsibility for any and all damages incurred as a result of Passenger(s) failure to comply with applicable documentation requirements, including but not limited the requirement that all Passengers procure, and have on their person the proper travel documents at all times. Spetter Travel/Pink Chicken Vacations® recommends the Passenger(s) consult with the appropriate domestic and foreign governmental agencies for the current document requirements.

4. PROOF OF IDENTITY: All Passengers must present accepted photo identification such as a passport or other state or government-issued photo
IMPORTANT INFORMATION FOR DOMESTIC AIR TRAVELERS: The Federal Real ID Act mandates stricter security standards for state-issued driver’s licenses and other forms of identification and prohibits Federal agencies from accepting for official purposes identification that does not meet these standards. Beginning on May 7, 2025, every air traveler will need to present Real ID-compliant identification to be permitted to board a domestic flight; therefore, those holding a non-compliant driver’s license will need to present an acceptable alternate form of identification, such as a valid U.S. passport. To avoid disruption to their travel plans, air passengers are strongly encouraged to consult with the Department of Homeland Security (www.dhs.gov/real-id) to determine whether their state-issued identification is Real ID-compliant and, if not, what alternate forms of identification will be accepted at the airport.

5. PASSPORTS AND VISAS: Passenger(s) must have a passport to travel to another country. Passenger(s) assume full and complete responsibility for checking and verifying any and all passport, visa(s), vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. International destinations may have additional requirements such as a visa that you must obtain prior to departure. If Passenger(s) are a non-US citizen, different immigration requirements apply. Passenger(s) is responsible for contacting consulate(s) required. Without proper identification, or passport and necessary visas, Passenger(s) will not be permitted to depart. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record should review current entry requirements. https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/inadmissibility.html
Some countries require both parents’ consent for minors to travel.
Spetter Travel/Pink Chicken Vacations® has no control over the issuance of visas or approval of visa waivers related to your travel. Should a visa not be issued, Spetter Travel/Pink Chicken Vacations® is not responsible for lost payments. Please note that rules of each country regarding entry and exit change on a daily basis.

6. PAYMENTS: Spetter Travel/Pink Chicken Vacations® holds reservations until “Deposit Due Date” indicated on your confirmation. If deposit/payment is not received by Spetter Travel/Pink Chicken Vacations® on or before the Deposit Due Date, reservations are automatically cancelled. Failure to remit payments on a timely basis will automatically put your booking at risk of cancellation. Please contact us immediately, and in advance of your payment due date, if you will be unable to meet this obligation. Without limitation, Passenger(s) voluntarily hold Spetter Travel/Pink Chicken Vacations® harmless for cancellation of any booking for either late payment or declination of a credit card.

7. RESERVATION RULE VIOLATIONS: Passenger(s) agree not to purchase a ticket or tickets containing flight segments that you will not be using. This practice is known as “Hidden City Ticketing” or Back-to-Back Tickets” and is prohibited. The purchase and use of round-trip tickets for the purpose of one-way travel only, known as “Throwaway Ticketing” is prohibited. The use of two or more different tickets issued at round trip fares for the purpose of circumventing applicable rules (such as advance purchase/minimum stay requirements) commonly referred to as “Back-to-Back Ticketing” is prohibited. Where a ticket is purchased and used in violation of these rules the applicable air carrier have the right in their sole discretion to take all actions permitted by law, including but not limited to, the following: Invalidate the ticket(s); Cancel any remaining portion or your itinerary; Confiscate any unused Flight Coupon; Refuse to board you; Assess you for the actual value of the Ticket which shall be the difference between the lowest fare applicable to your actual itinerary and the fare actually paid; Delete miles in your frequent flyer account and/or terminate your participation in the program.

8. PRICING: Prices and availability quoted by Spetter Travel/Pink Chicken Vacations® are not guaranteed until deposit is fully paid. Pricing and availability may change without notice. Passenger agrees that Spetter Travel/Pink Chicken Vacations® is not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies nor is Spetter Travel/Pink Chicken Vacations® responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold Spetter Travel/Pink Chicken Vacations® harmless for any actions or damages arising from Supplier pricing. Spetter Travel/Pink Chicken Vacations® reserves the right to charge Passenger(s) for any increase in taxes, fees or surcharges (i.e. fuel). Passenger(s) acknowledge this right and agree to pay any such additional taxes, fees, and surcharge.

9. AGENT FOR SUPPLIERS: Spetter Travel/Pink Chicken Vacations® and its independent travel advisors (collectively “we” or “us”) act as intermediary between the Suppliers and the public. Spetter Travel/Pink Chicken Vacations® does not own or operate any hotels, shore excursions, tours, transportation providers, cruise lines, vessels, airlines, travel protection companies, attractions, or other travel-related Suppliers who provide goods or services for the Passenger(s)’ trip. Spetter Travel/Pink Chicken Vacations® is not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, whether willful or negligent, criminal or otherwise, or failure to honor future trip credits. You acknowledge that your travel plans may be interrupted or cancelled by the Supplier, a government entity, or other third party over which we have no control. You further acknowledge that the Supplier's own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern your rights and remedies, including Passenger(s) right to receive a refund. Spetter Travel/Pink Chicken Vacations® has no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund.

Suppliers reserve the right to deviate from the direct, customary and/or scheduled route or itinerary for any reason, without limitation and without notice. Passenger(s) acknowledge and agree that Spetter Travel/Pink Chicken Vacations® is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections or any other condition beyond its control. Spetter Travel/Pink Chicken Vacations® is not liable for any loss due to Passenger’s gambling and is not responsible for any purchases made while on the trip.

Spetter Travel/Pink Chicken Vacations® recommends that all Passengers be in good physical and mental health and have medical approval to travel. Any physical disabilities must be reported to Spetter Travel/Pink Chicken Vacations® at the time of reservation upon initial booking so Spetter Travel/Pink Chicken Vacations® can contact the Suppliers to investigate amenities and/or special accommodations offered. Passenger(s) is required to provide his or her own personal or individually prescribed devices such as wheelchairs, walkers, or similar devices. If more than minor assistance is needed, Suppliers may require that the Passenger be accompanied by a companion who is capable of, and responsible for, providing such assistance. Suppliers often reserve the right to reject Passengers whose mental or physical condition may interfere with the itinerary. Passenger(s) acknowledge and agree that Spetter Travel/Pink Chicken Vacations® shall be held harmless for any and all claims relating to Supplier rejection relating to mental or physical condition.

While Spetter Travel/Pink Chicken Vacations® prides itself on selecting top quality Suppliers, no undertaking, guarantee or warranty is given or shall be implied as to the fitness or condition of the Supplier’s accommodations, transportation, or any food, drink, medicine, or provisions supplied. Passenger(s) acknowledge and agree that Spetter Travel/Pink Chicken Vacations® shall not be responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier. In no event shall Spetter Travel/Pink Chicken Vacations® be liable for any accident which occurs in hotels, in resorts, on airplanes/in airports, on buses/in bus stations, on trains/in train stations, on board a cruise ship, on tenders, on shore excursions, or during any mode of transportation encountered during the trip, resulting from equipment or any other cause. The Passenger admits a full understanding of the nature and character of the mode of transport and assumes all risks of travel, transportation and handling of passengers and baggage.

10. RISKS OF TRAVEL: Without limitation, Passenger(s) assume the risk of, and agree that Spetter Travel/Pink Chicken Vacations® is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at commencement of the trip, desertion or revolt of crew, or lost/damaged/delayed luggage. Ultimately, it is Passenger(s) responsibility to understand and abide by all requirements and restrictions when traveling. This may include the following: health affidavit forms; health screenings prior to departure and/or upon arrival; temperature screenings prior to departure and/or upon arrival; travel reason affidavit forms; online travel authorizations; airline safety & health requirements, such as health forms, screenings, face coverings; in-country requirements, such as periodic temperature checks, quarantine, face coverings; visas. Failure to meet the requirements and/or restrictions puts you at risk for fines, quarantine or deportation at your expense.

11. EXCURSION AND PROMOTIONAL FARES: Most discount fares involve certain restrictions. A change in carrier(s) flight(s), time(s) or routing(s) could result in a carrier demanding a full fare. Obtain agency or airline assistance before making changes.

12. TIMES, FLIGHTS AND FARES: Times, flights and fares are based on current tariffs that are subject to change without notice. Minimum check-in for domestic flights is 2 hours; international flights, 3 hours. Due to heightened security measures, it is advised you allow extra time before scheduled departure. Failure to arrive within your airline's specified time could result in denied boarding.

13. PRICE DROPS: If a Supplier drops the price of a trip after booking, Spetter Travel/Pink Chicken Vacations® will attempt to assist Passenger(s) with rebooking if the Supplier allows it, and a fee may apply. Spetter Travel/Pink Chicken Vacations® does not guarantee any refunds or successful rebooking.

14. TOUR, CRUISE AND PACKAGE PRICES: Tour, cruise and package prices are subject to change without notice due to currency fluctuations, tariff changes. In addition, some group tours/packages are based on a minimum number of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed on all passengers, or the tour may be cancelled. Any cancellation of a tour or package for reason of failing to meet the minimum traveler requirement will be governed by the tour operator’s cancellation policy.

15. IF YOUR PLANS CHANGE ENROUTE: If your plans change enroute, check with your travel agent or airline carrier for charges, changes and applicable fees.

16. OVERBOOKING: Airline flights may be overbooked. A person denied boarding on a flight may be entitled to a compensatory payment. The rules for denied boarding compensation are available at all ticket counters.

17. CANCELLATIONS AND REFUNDS: All cancellations or no-shows are subject to penalties imposed by the supplier. In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. All cancellation requests must be sent to Spetter Travel/Pink Chicken Vacations® in writing. Any third-party Supplier’s cancellation penalties will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund. If you are holding guaranteed hotel or car reservations you wish to cancel, you must contact Spetter Travel/Pink Chicken Vacations® in writing or the vendor directly adhering to their cancellation policy. Spetter Travel/Pink Chicken Vacations® is not responsible for paying you for any loss you incur due to your failure to travel or your failure to follow the change or cancel policies of any travel vendor. Spetter Travel/Pink Chicken Vacations® reserves the right to charge processing fees in the event of refunds, cancellations and other services.
If a Supplier does not provide the service or ceases operations, your recourse is against the Supplier, not us. Except in cases of fraud, you agree not to file any dispute with your bank or credit card company to avoid or violate any booking terms and conditions of Spetter Travel/Pink Chicken Vacations® or its suppliers, including cancellations, changes of itinerary or arrangements for reasons beyond the control of Spetter Travel/Pink Chicken Vacations® or its suppliers. If you attempt to chargeback, reverse or recollect a previously authorized trip payment, Spetter Travel/Pink Chicken Vacations® reserves the right to collect all additional costs, fees and expenses associated with such chargeback, reversal or recollection, including, without limitation, attorney fees.

18. TRAVEL PROTECTION/INSURANCE Travel insurance protection is Strongly Recommended. As your travel agent, we have a professional responsibility to recommend the purchase of travel protection to protect both you and your vacation. While we do offer coverage through certain carriers, we cannot compare all the policies or companies currently in the marketplace. This responsibility rests solely with you the customer. IF YOU ELECT TO PURCHASE travel insurance, please review your confirmation for accuracy. The terms of the policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances of a pandemic, pre-existing medical conditions, and other policy exclusions. Consult the insurance carriers directly for details. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. BY DECLINING travel protection, you acknowledge and accept liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred. You also acknowledge and accept responsibility for arranging and paying for any treatment in case of a medical emergency while traveling. Please note that if you decline this type of coverage, you have waived your right to this important coverage and your confirmation will note “declined” next to the travel protection section of your confirmation.
If you believe you have travel protection and your confirmation indicates declined, Failure to contact us immediately will be considered waiver of travel protection. You agree to hold us harmless for your election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to Covid-19 or any other claim under the policy.
All requests for service under the policy must be filed directly with the travel insurance provider, in accordance with the policy terms and conditions, which you the passenger are responsible for reviewing upon receipt of your travel protection policy. Spetter Travel/Pink Chicken Vacations® is not a licensed insurance broker, thus not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. All queries regarding cancellation, penalties, coverage should be directed to your particular travel insurance provider.
Spetter Travel/Pink Chicken Vacations® cannot guarantee that any insurance provider will approve coverage for a claim made under the insurer’s policy and makes no representations about the extent of coverage for any policy it may offer or quote.

19. CLIENT CONDUCT: Each participant in any trip arranged/booked/escorted by Spetter Travel/Pink Chicken Vacations® is expected to act responsibly and adhere to all behavior guidelines established by Spetter Travel/Pink Chicken Vacations® and our Suppliers. Spetter Travel/Pink Chicken Vacations® and all local Suppliers reserve the right to remove you from any facility, hotel or resort property, tour location or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other clients on any element of your trip, or interferes with the operation or security of the places we visit. In any such case, there will be no refund.
When you book with Spetter Travel/Pink Chicken Vacations®, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip, or any portion of a trip. You agree not to hold Spetter Travel/Pink Chicken Vacations® or any of its related entities liable for any actions taken under these terms and conditions. Baggage and personal effects are at all times the sole responsibility of the participant.

20. LIMITATION OF LIABILITY: Without limitation, Passenger(s) assume the risk of, and agree that Spetter Travel/Pink Chicken Vacations® is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at commencement of the trip, desertion or revolt of crew, or lost/damaged/delayed luggage.

21. TRAVEL CONSUMER RESTITUTION FUND (TCRF) DISCLOSURES: If you reside in California, this transaction is covered by the California Travel Consumer Restitution Fund (TCRF). Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim. 22. CHANGES TO THESE TERMS: Spetter Travel/Pink Chicken Vacations® reserves the right in our sole discretion to change these Terms and Conditions at any time. Updated versions of the Terms will be provided to Clients.

23. CLAIMS DEADLINE AND EXCLUSIVE JURISDICTION: You agree to present any disputes against us within 30 days after your trip ends and to file any claim within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree that the courts in San Diego County, California will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.
